This paper contains an overview of the Public Procurement Act (OG 120/16) regulations and several international legal instruments (conventions, framework decisions, directives) on the suppression of corruption, with emphasis on the legal practice obligation in public procurement procedures. The paper deals with the emerging forms of criminal behavior of contracting authorities and economic subjects in public procurement procedures, as public procurement is one of the key domains for corruption, as well as other undesirable practices such as preferential treatment and bribery. Review of the relevant literature and the existing researches in this paper shows the arguments that the principles of public procurement and the EU regulation are not sufficient guarantees to suppress specific corruption risks in the Republic of Croatia. In order to combat corruption, a raised public awareness is necessary along with the explanation of the fact that corruption is ultimately at citizens’ expense, and that the functioning of the society and the country in which they live is being questioned due to corruption. The purpose of this final work is to point out the importance of the transparency principle in the public procurement system. The Republic of Croatia has a great potential for progress in the field of public procurement if it will insist on a broad and thorough social change and raise public awareness of corruption in a way that corruption in public procurement is adequately punished.
