In the national legislation Public - private partnership is defined as a long-term relationship between the public and private partners, whose subject of cooperation and business make the construction and / or reconstruction, and maintenance of public buildings, all for the purpose of providing public services falling within the competence of the public partner. The basic aim of this paper is to clearly define and establish the very management structure between public and private partners, as well as to define and emphasize the importance of the relationship between the public and private sectors, which is also the condition for the success of the PPP. This work, by itself, is trying to approach and make clear the very concept of public - private partnership from the very beginning the idea of a public authority to its development, and finally the selection of the private partner and the approach phase of the execution of the signed contract. One of the important characteristics of this type of legal work is a high monetary value and durability. In order for the project, during the contractual period, is well managed and successfully completed, it requires a professional approach and a well-developed system of risk management and, as the crown of the actual implementation of contractual obligations, a quality leader. The paper deals with problems, such as financing PPP, making the cost comparator (PSC) as well as the appearance of the PPPand also clarifies the application of the legislation itself.
