Abstract | Ovim radom ukazuje se na moguće postupke javne nabave, provođenje postupaka javne nabave, izradu dokumentacije o nabavi i ugovaranje. Područje javne nabave u Republici Hrvatskoj zadnjih je godina jako unaprijeđeno i usklađeno s pravnom stečevinom Europske unije. Rad je koncipiran u nekoliko cjelina. U uvodu je ukratko opisano područje javne nabave s novinama donošenja novog Zakona o javnoj nabavi kojemu je cilj usklađenost zakonodavnog okvira u području javne nabave u Republici Hrvatskoj s pravnom stečevinom Europske unije. U drugoj se cjelini nalazi pregled postupaka javne nabave, a to su: otvoreni postupak, ograničeni postupak, natjecateljski postupak uz pregovore, natjecateljski dijalog, partnerstvo inovacija i pregovarački postupak bez prethodne objave poziva na nadmetanje. U završnom je dijelu te cjeline detaljnije objašnjena razlika postupaka u provođenju javne nabave. U trećoj cjelini nakon odabranog postupka javne nabave slijedi kompletiranje dokumentacije o nabavi koju provodi naručitelj. U dokumentaciji o nabavi navode se opći podaci naručitelja, podaci o predmetu nabave, razlozi isključenja natjecatelja ili ponuditelja u postupku javne nabave, odredbe o sposobnosti natjecatelja ili ponuditelja, podaci o zahtjevu za sudjelovanje i/ili ponudi te ostale odredbe. Nakon toga, u četvrtoj cjelini slijedi postupak zaprimanja, javnog otvaranja i pregleda ponuda ili zahtjeva. Ponuditelji nakon stavljanja dokumentacije u Elektronički oglasnik javne nabave Republike Hrvatske šalju naručitelju ponudu sa svim podacima koje naručitelj navodi u dokumentaciji o nabavi. Nakon zaprimanja naručitelj otvara ponude na javnom otvaranju, pregledava ih i ocjenjuje. Odluke naručitelja u postupku javne nabave su: Odluka o odabiru ponude, Odluka o poništenju postupka javne nabave i Odluka o nedopustivosti sudjelovanja. Postupak javne nabave završava izvršnošću Odluke o odabiru ili poništenju. Nakon proteka roka mirovanja i izvršnosti Odluke o odabiru, ugovorene strane sklapaju Ugovor o javnoj nabavi ili Okvirni sporazum u pisanom obliku, a koji moraju sadržavati ove dijelove: uvodne odredbe, predmet i trajanje, uvjete, razloge za raskid, jamstvo za izvršenje Okvirnog sporazuma, sklapanje Ugovora o javnoj nabavi i ostale odredbe. Na kraju je dan osvrt na završni rad u cjelini. |
Abstract (english) | This article points out possible public procurement procedures, the implementation of public procurement, preparation of procurement documentation and contracting. A lot of changes have been done recently in domain of procurement procedure sin Croatia. They have been improved and synchronized with the new EU procurement rules. The article is conceived into several sections. The introduction gives a brief description of public procurement area including new significant directives whose main goal is legislation of the Croatian public procurement legal framewok with the specific directives. The second section gives the review of public procurement procedures, and these are: opened procedure, restricted procedure, competitive procedure with negotations, competitive dialogue, partnership of innovations and negotiation procedure without prior publication of a contract notice. Detailed difference of each procedure in implementation of the public procurement is described in the final part of the same section. In the third section, after the selected procurement procedure, completion of the procurement documentation carried by the client is followed. In the procurement documentation there is general information about the client, about the objectives, reasons for exclusion of candidates or tenders in public procurement procedures, directives about the abilities of candidates or tenderers, applications information for participation and/or tender as well as other directives. After that, in the fourth section, the procedure of acceptance, public opening and analysis of tenders or reqests follows. After publishing documentation in the Electronic Public Procurement of Croatia, bidders send the tender to the client the offer with all the data that the client states in the procurement documentation. After the reception, the client opens the bids at the public opening, reviews and evaluates them. Client's decisions in public procurement are: decision about bid selection, decision on cancellation of the procurement procedure and decision on the inadmissibility of participation. The public procurement procedure closes with the exellence of the decision on selection or cancellation. After the standstill period expiry and enforceability of decisions on the selection, contracted parties conclude a public contract or a framework agreement in written form. They have to contain these parts: introductory directives, objectives, duration, conditions, excuses for termination, guarantee for execution of the Framework Agreement, conclusion of the public procurement contract and other regulations. As a conclusion, a reviewof the final work has been done. |
