Abstract
Predmet ovog diplomskog rada je prethodni postupak pred Europskim sudom, koji je uređen člankom 267. Ugovora o funkcioniranju Europske unije, te u njemu piše da je Sud Europske unije nadležan donositi prethodne odluke o tumačenju Ugovora, valjanosti i tumačenju akata, institucija, tijela, ureda ili agencija Unije, te da prethodni postupak mogu pokrenuti samo sudovi država članica. Europski sud jedan je od sudova unutar Suda Europske unije, odnosno jedan od institucija Europske unije, kojih ukupno ima sedam, a to su: Europski parlament,Europsko vijeće,Vijeće ministara,Europska komisija, Europska središnja banka, Revizorski sud te Sud Europske unije. Sud Europske unije, njegova organizacija i struktura uređeni su Ugovorom o Europskoj uniji, Ugovorom o funkcioniranju Europske unije, Statutom suda i Pravilima postupka, pa se tako Sud Europske unije sastoji od tri suda, a to su: Europski sud, Opći sud i Službenički sud.
Abstract (english)
The subject of this diploma paper is the preliminary procedure before the European Court, which is regulated by the article 267 of the Treaty on the Functioning of the European Union, and it states that the Court of Justice of the European Union is competent to make preliminary decisions about interpretation of the Treaty, as well as about the validity and interpretation of the acts, institutions, bodies, offices or agencies of the Union, and that preliminary procedures can be initiated only by the courts of the member states. The European Court is one of the Courts within the Court of the European Union, i.e. one of the seven institutions of the European Union. These are: the European Parliament, the European Council, the Council of the European Union (the Council of Ministers), the European Commission, the European Central Bank, the Court of Auditors and the Court of Justice of the European Union. The Court of Justice of the European Union, its organization and structure are governed by the Treaty on European Union, the Treaty on the Functioning of the European Union, the Statute of the Court of Justice and the Rules of Procedure. Thus, the Court of Justice of the European Union is divided into three bodies: Court of Justice, General Court and Civil Service Tribunal.
