Property rights are recognized in almost all modern countries and, in many, represent a protected category of rights. In Croatian law, it is guaranteed and protected primarily through the highest legal act of the Republic of Croatia - the Constitution of the Republic of Croatia. The inviolability of property rights is one of the highest values of our constitutional order. In the Republic of Croatia, issues of property rights are regulated in more detail by the Law on Ownership and other real rights, which establish a general regulation of belonging to persons, i.e. regulate issues of all forms of ownership - individual ownership, co-ownership, joint ownership and condominium ownership. There are frequent legal and real life situations where several people own the same thing, that is, they have a co-ownership over a particular subject, with problems occurring, especially when they wish to end such co-ownership, as is discussed in this thesis. The purpose and goal is to resolve the issues that arise when the co-ownership community is terminated, such as the division of the property concerned and the further regulation of ownership, both among the owners and third parties. The final goal is to reach a simpler and more "painless" solution between the former co-owners, in order for each to continue to dispose of his or her part freely, that is, to exercise their property rights and duties that belong to it.
