The subject of this paper is the role of the attorney as a lawyer in litigation. Representation of parties to the court is one of the most important functions of law as an institution and one of the main activities of a lawyer as a profession. The paper starts with general remarks on the power of attorney and the position of the attorney. It further determines the scope of the power of attorney and separately handles the power of attorney for a particular civil action, civil power of attorney and general power of attorney. The paper also addresses the issue of termination of power of attorney. After that, the work deals with the issue of disagreement between the attorney's and the party's procedural actions with an important remark on procedural audit at the end of the first part. The second part deals with the subject of a State attorney as a lawyer. First, the office of the State Attorney General is explained alongside an explanation on the role of the Judicial Academy in selecting candidates for judicial officials who become trainees and deputies in the State Attorney's office. After that, the paper deals with the position and function of the State Attorney as a lawyer in litigation. The third part of the paper deals with the institution of attorney in general. The basics of the attorneyship and the issue of payment for work are mentioned, followed by the subject of the attorney's office and attourney`s association and ultimately an attourney`s disciplinary responsibility. In the last part of the paper, the Codex of Attorney's Ethics is elaborated, starting with the general principles. Furthermore the paper covers parts of the Code relating to the institution of Confidentiality, the relationship with the attourney and his client as well as the opposing party, the mutual relations between attourneys and, finally, the relations with attourney trainees.
