Enforcement against financial assets of the enforcement debtor represents a special procedure for collection of the claim. Basic issues to be elaborated in the paper refer to the position of Fina in the enforcement procedure, limitation of the amount of salary available for collection considering the amendments to the legislative framework in the last few years, the position of the enforcement debtor in the procedure and the issue of priority in the collection of the assets. The paper contains thirteen chapters. The introduction comprises the analysis of the subject matter and the aim of the research paper. Part two refers to the definition of enforcement procedure and the relationship between the parties (enforcement creditor and enforcement debtor) and part three describes initiation of the enforcement proceedings, the parties and the subject matter of enforcement proceedings. The enforcement proposal and the judgment rendered in enforcement proceedings are explained in part four, whereas part five provides an introduction into an actual execution against financial assets. Part six gives a detailed account of the Enforcement Act with descriptions from the stage of issuing of enforcement title until its execution. Part seven elaborates on the freezing and unfreezing of the debtor’s accounts, and part eight provides an exhaustive list of earnings exempt from enforcement and limitations of enforcement, with a focus on the salary. Part nine gives an account of registers – Single accounts register and the Register of debentures and blank debentures. Part ten deals with enforcement costs, and part eleven elaborates on specific provisions on the enforcement against salary, with regard to the judgment on enforcement, collection upon consent of the debtor and the direct collection procedure. Part twelve contains the comparison with the enforcement proceedings based on the Act on worker claims insurance and part thirteen places emphasis on public media and statistical data.
