Every country has a more or less developed system that implements upbringing and formal education. Such a system builds an important pillar that shapes the fundamental knowledge and skills of citizens, and consequently, as such, develops society. In the Republic of Croatia, the educational system is divided into four levels: early and preschool education, primary school education, secondary school education and higher education. The above-mentioned levels are carried out in predetermined educational institutions whose work is the responsibility of the Ministry of Science and Education (hereinafter: the Ministry). The educational system in the Republic of Croatia is mostly centralized, but the Ministry decentralizes certain functions and puts them under the authority of the founders of educational institutions. Special regulations stipulate that the activity of upbringing and education is performed in the capacity of public services. The constitutional provision in the Republic of Croatia advocates for the equal availability of public services to all citizens of the Republic of Croatia, which entails the adoption of legal regulations on the establishment of an employment relationship in educational institutions. When establishing an employment relationship, they are obliged to announce public tenders, except in the case of prescribed exceptions. Considering that the most professional personnel is sought, special regulations regulate which general and special conditions, that is, which criteria’s the candidates of the tender procedure must meet in order to conclude an employment contract with them. The method of evaluation of the candidates of the tender procedure was not adopted at the state level, instead, educational institutions were given autonomy to, according to the instructions of the Ministry or the founder, with their prior consent, to pass internal acts which regulate the evaluation of candidates which causes unequal availability of public educational services at the state level of the Republic of Croatia. The aim of this paper is to explain the employment process at all four levels of the educational system in the Republic of Croatia from the aspect of public services.
