The family is a basic social institution that is most often established by marriage. Due to the increased number of divorces, there is a need for a deeper study of this topic, especially from the perspective of the child's right to parental care of both parents after divorce. Divorce is not an easy process, both for parents and children. While growing up, children need the presence of both parents, which is why, in the context of divorce, exceptional importance is attached to joint parental care after the divorce of the child's parents. This paper first presents the divorce procedure in which there is a minor child, then explains the child's right to parental care, as well as the concept and content of parental care. The paper gives a special overview of the ways of achieving parental care after the divorce of the child's parents, as well as the right of the child to express his opinion in divorce proceedings. In addition to the legal regulations, the paper also contains the processing of statistical data related to divorces with minor children in the Republic of Croatia from 2017-2021. years. Given that an important aspect of the study is the adaptation of children to the divorce of their parents and the protective factors in relation to the child, the final part of the paper is dedicated to the adaptation of the child to divorce as well as the role of the social worker in the divorce proceedings of the parents of a minor child.
