The topic of this diploma thesis is child participation and protection of children's rights in family mediation procedures. In Croatia, family mediation in the form in which it is implemented today began to be implemented with Family Law from 2015. Family mediation is carried out by specially trained persons, family mediators. Family mediation is most often used to reach an agreement regarding parental care after a divorce, but it can also be used to resolve other disputes between family members. When it comes to reaching an agreement on parental care, in addition to the parents themselves, an important factor is certainly the child, who has the right to express his opinion regarding such agreements. In all procedures in which certain decisions are made regarding the child, it is imperative to protect the best interests of the child. When it comes to family mediation, there are certain doubts about the participation of children in this procedure, the advantages and disadvantages of their participation and mechanisms for protecting their best interests in the same procedure, which is discussed in detail in this paper. The paper also analyzes the results of research conducted on different models of children's participation in out-of-court procedures for resolving family disputes, their personal views on whether to participate in such procedures, and the role of parents in making a decision on the child's (non) participation in the same procedures.
