The drawing up od a will is possible for all citizens if they are determined to expresstheir will in such a way. A will is a document by which te testator defines how he wants his property to be distributed after his death. If it is written in accordance with the law, it represents a stronger legal basist then the legal right of inheritance. The law defines the preconditions for drafting with regard to the testator. Forms of will also contain preconditions that must be met if we want the will to produce legal effect. We divide willls in the manner of their compilation and additional conditions prescribed by law regarding additional persons (witnesses) as a condition of their validity. The basic division in into regular and extraordinary, and regular are divided into private and public. The way of division is to hint at the basic assumptions for each individual will. A personal will, it belongs to the regular and private, and is compiled by the testator and signed by himself. The will before witnesses also belong to the regular and privates ones, and it is drawn up in such a way that the testator declares the content of the last will before the witnesses and signes it. Unlike private ones, public wills require the participation of public bodies. Public wills include international and public wills. An oral will is the only extraordinary will that is made extraordinary circumstances and it is last reliable formo f a last will and testament. The testator may keep the will independently or hand it over to another natural or legal person for safekeeping. Entry in the Croatian register of wills does not constitue a condition for the validity of the will. Testamentary heirs may find it more difficult to compete with the envisaged property by placing a burden in the will. The executor of the will may also be appointed, who has the duty to realize the last will of the testator. The legal effects of a will occur after the death of the testator, without prejudice to the necessary heirs.
