In Republic of Croatia, the Family Law regulates the adoption procedure and the obligations of the parties in procedure. The Social Welfare Center is really competent body for conducting adoption procedure. Fundamental to the forehead on which adoption is based is the principle of best interests of child. In accordance with this principle, it is important when conducting the adoption procedure to start primarily from the fact that a child without adequate parental care needs to be provided with family life and not from the desire of potential adoptive parents to become parents and exercise the right to parental care. Marital and extramarital partners can adopt together, only one of them in case he adopts a biological child of his spouse or extramarital partner, only one spouse or extramarital partner with the consent of the other and a person who is neither in a marital nor extramarital union. The parties in adoption process are the child and the most appropriate adoptive parent. The Social Welfare Center selects the most favorable adopter from the register of potential adopters according to the assesment of suitability and suitability. Adoption is based on a decision on adoption issued by the competent social welfare center. When the decision becomes final, a new legal relationship arises between the adopter and the adoptee and it is registered in the birth register.
