It is a fundamental parental right and duty to care for their children. Each child has the right to have both parents involved in his upbringing and they are essential for his proper growth and development. If parents want to get divorced, the legislator encourages them to decide independently and by mutual agreement in the best interests of their child and decide in agreement how parental care will be provided after the end of their life together. Parents are given disposal of mandatory consultation and family mediation, procedures in which professionals help them finding the best solution for their family situation. Parents can continue providing mutual parental care by agreeing of shared parental care or leave the decision to the court of justice. Court of justice will decide of legal consequences of divorce in relation to the child; about parental care, personal relationship with parent whom he does not live and alimony. Regardless whether parental care will continue mutually or independently, obligation to maintain and continue personal relationship with a child remains on the parent who does not live with the child. Both parents must provide their child level of the material existence which their incomes allow them. Those can be in a form of financial giving or in a form of day to day parental care which provides the parent with whom the child continues to live.
