The bill of the new Enforcement Act (hereinafter: 2020 EA Bill), which will soon enter into force, indicates that enforcement will once again fall within the jurisdiction of the courts. Given that writs of execution based on authentic documents issued by public notaries were not enforceable in the memeber states of the European Union, the applicable 2017 Act had to be amended. Pursuant to the new Act, writs of execution based on authentic documents will be issued by the courts. Although many legel experts claim that judgments of the Court of Justice of the European Union are not applicable to parties in the Republic of Croatia, but only to parties in cases with cross-border elements, the legislator has nonetheless decided to amend the Enforcement Act. It remains to be seen whether that is a good decision or the courts will be additionally burdened with new enforcement cases. According to the 2020 EA Bill, public notaries will become a subsidiary body, that is, they will be court-appointed trustees in the performance of enforcements. Many believe that once the new Act enters into force, the enforcement procedure will last longer and be more expensive instead of being cheaper-as predicted earlier. Considering that public notaries have been faced with the corona crisis for the past several months, and that all writs of execution have been suspended, it will be interesting to observe the enforcement situation in autumn, and see what it will mean for Croatian citizens facing enforcement.
