This paper analyzes the way in which criminal law offers protection to people with disabilities, considering the fact that violence against people with disabilities is a common occurrence in today's society. The beginning of this paper analyzes the term „person with disability“ in Croatia's legal system through regulations of the Constitution of the Republic of Croatia, certain international contracts and laws, because a universally accepted definition of the term doesn't exist. Convention on the Rights of people with disabilities offers the most acceptable definition of a person with disability and it represents the first legaly binding international document which defines and protects the rights of people with disabilities. The institute of Ombudsman, which, according to the 2. article of Zakona o pravobranitelju za osobe s invaliditetom „protects, follows and promotes rights and interests of people with disabilities“ was established in Croatian society. The next part of this paper lists the forms of violence against people with disabilities, the consequences of such violence and the reasons why this type of violence is rarely reported. People with disabilities are a vulnerable social group which is why they are more frequently subjects of violence, and despite there being a large number of laws which regulate violence, they are not protected enough. In continuation, the way in which criminal law protects people with disabilities through regulations of individual offenses (often as a qualified form of some criminal offense) and the concept of a vulnerable individual which is introduced by KZ/11 are analyzed. The last part of this paper analyzes, in detail, the verdict of European court of Human Rights in the Đorđević versus Croatia case, where the violation of rights guaranteed by the European Convention on Human Rights in regards to the applicants is established and a fair compensation is awarded to them. This case demonstrates the difficulty of approaching underage perpetrators of criminal offenses who are not criminally liable because of their age, and the authorities' absence of response to the perennial maltreatment and molestation of people with disabilities by a group of children.
