The subject of the master's degree relates to the evidence in the litigation. The aim of the work is to explain the evidence in the proceedings, to present evidence, to individual evidence and how individual evidence is presented. At the very beginning of the work, the concept of proof is defined, and the whole work permeates the way the individual evidence is used before the court. Each party has the ability to present evidence on which he bases his claim. The parties to the litigation may behave in different ways during the proceedings so they can be active in litigation and passive and then increase the likelihood of loss in litigation and this is their only sanction. To provide evidence means that evidence is taken when it is possible, not when it is possible on a regular basis.In individual pieces of evidence we include investigation, documents, witnesses, experts, but also parties.Courts adjudicate on the basis of the Constitution and the law, and when presenting evidence, the court that makes the decision must be the one before which the evidence is presented. The Court is free to assess the veracity of the evidence and to give an appropriate judgment on that basis nor is it bound by the dispositions of the parties, which is an expression of the principle of free assessment of evidence
