The subject of this paper is the study of the institute of liability for damages in medical law and various legal issues that may arise from the relationship between providers and users of health care services. Firstly, introducing the legislative framework in the field of medical law, which is, as an independent scientific discipline in our country, in its beginning. The fundamental part of the paper is devoted to the assumptions, types and characteristics of liability for medical damages, as a part of civil indemnity law, with special reference to the application of objective liability for damages arising from the use of medical devices. In the rest of the paper, the assumptions required for release of liability are outlined and, finally, the institute for professional liability insurance of health professionals in the Republic of Croatia is explained in comparison with the so-called Scandinavian „no fault“ insurance model. Rights and obligations must be known in order to prevent errors in the treatment of health care professionals which may have fatal consequences, and on the other hand, in order to make the injured party aware of their right to compensation for the damage suffered.
