Civil Servants are persons who, in the state bodies, regularly engage in activities within the scope of these bodies as laid down by the Constitution, by law or by other regulations adopted under the Constitution and by law, as well as persons performing IT, public and administrative affairs, planning,-financial and accounting affairs and similar affairs. The requirements of legitimate, efficient and transparent state administation impose the need to prescribe the liability of officials for violations of official duties. Civil servants are responsible for violations of official duty if they do not perform their duties in a conscientious, professional and timely manner if they do not comply with the Constitution, laws and other regulations or rules of conduct during service or in connection with the service. The civil servant may, by the same act, observe the characteristics of the offense of official duty and criminal offense, but the conduct of the proceedings for the violation of official duty is not related to the criminal proceedings or the decision of the body in that proceeding. The law on Civil Servants is a regulation of the general civil law and it prescribes the general conditions of liability for the violation of official duty, the type of such violations, the prosecuting authorities for breach of official duty, the proceedings and penalties in these cases, and the conditions for dismissal from the service.
