Divorce as a social phenomenon is an increasingly common topic of research in different fields of science. The reason for this is the complexity of this social problem and many aspects it encompasses, starting from the psychological aspect, through a legal and legislative point of view all the way to the influence it has, both globally and on the individual. In the Republic of Croatia, divorce is legally regulated by the Family Law of 2015, and given how the divorce process can be resolved out of court, out of litigation and within the court, in litigation, many actors can participate in its resolution, such as social workers, lawyers, judges, psychologists, and under the new Out-of-Court Procedure Act, notaries. This thesis deals primarily with the rights of the most vulnerable that this problem affects, and these are minor children, whose voice is not heard enough and whose opinions we need to fight for on a daily basis. As a signatory to the Convention on the Rights of the Child, Croatia has a duty to make every effort to protect children's rights and to correct the mistakes present in our system on a daily basis. The aim of this paper is to point out the paramount importance of the social worker as an actor in the protection of children's rights in divorce proceedings and to raise awareness of the need for protection in every sense of those on which our society remains, and these are children.
