The family is the most important environment in a child's growth. Parents are the ones who have the primary responsibility for the child's upbringing and who have the greatest influence on his development and upbringing. If there is a certain negligent discrepancy between the child and the parents, there is a state that seeks to resolve such cases in order to protect the best interests of the child. Any measure that distances the child from the parent, with deprivation of the right to parental care being the most difficult measure, raises a number of complex issues in seeking a compromise between protecting the child's best interests and the parent's primary right to care for the child. Although the measure of deprivation of the right to parental care is taken with the aim of protecting the child's life and health, we should not forget the negative consequences that this measure may have in certain circumstances for the child. It is clear that certain actions of parents, such as violent behavior towards the child and other extremely gross violations of the child's rights and endangerment, unquestionably justify taking a measure of deprivation of parental care, but often the circumstances are such that the degree of endangerment of the child by parents doubts as to whether the measure of deprivation of the right to parental care is an appropriate measure to protect the child's personal interests. There is no doubt that the safety of the child is a priority, and that the state must have developed mechanisms to protect the child, even when it is his parents, who should primarily protect him, who neglect, abuse and otherwise endanger his welfare. The court, in cooperation with the social welfare center, plays a major role in taking repressive measures to protect the personal interests of the child. The aim of this paper is an in-depth analysis of the legal regulation of the repressive measure of deprivation of the right to parental care, which will provide an overview and opinions of certain experts in this legal field, and conclusions based on the analysis.
