This paper explains in more detail the concept of mobbing, including its participants, types, forms, causes, consequences and prevention, and it also presents various legal solutions regarding the regulation of mobbing by EU member states at the national and supranational level. Mobbing is the continuing psychological abuse of a person in their workplace, often with the purpose of removing that person from the workplace. Mobbing is a concept of a modern age, so the legal regulation of it is still in its infancy in many countries, including the Republic of Croatia. The aim of this paper is to point out the need for better legal regulation so that victims do not remain unprotected and in order to strengthen legal certainty. Only a few countries in Europe have enacted a law that explicitly regulates psychological harassment in the workplace, while most still do not have such specialized law, but provide legal protection through the provisions of other laws regulating illicit and discriminatory behavior that is similiar to mobbing. Precisely because of insufficiently specialized provisions that should protect workers' rights from this type of abuse, there are many cases where the victim does not dare to oppose his abuser because he does not feel he enjoys sufficient legal protection which gives deceptive information about the amount and presence of mobbing. It is concluded that mobbing is a broad social problem that affects not only the victim but also the family members of the victim, the work organization and the state and society as a whole. Awareness of mobbing is not sufficiently developed and institutions need to approach this phenomenon much more extensively than the case has been so far.
