Abstract
Opće je poznata činjenica da kažnjavanje zahvaća gotovo sva područja ljudskog života i ima izrazito bitnu ulogu u regulaciji ljudskog ponašanja. Ono je i važan element regulacije međuljudskih odnosa unutar društvene zajednice. Oblici kažnjavanja nastajali su ovisno o društvenim strukturama, moralnim i vrijednosnim sustavima. One se mogu odraziti na društvo pozitivno, no u praksi većim djelom negativno, što samim time, nažalost, otežava život osobi kojoj su one izrečene, ali i njegovoj okolini. Upravo zbog toga primjena alternativnih sankcija, poput uvjetne osude i rada za opće dobro ima pozitivan odjek, npr. resocijalizacija, dobrobit zajednice, ekonomičnost i sl. Područje kaznenopravnih sankcija u Republici Hrvatskoj regulira se Kaznenim zakonom, prvi je donesen 1997. godine nakon čega su uslijedile brojne izmjene i dopune, a trenutni je Kazneni zakon usvojen 2011. godine. Prethodno su sankcije bile propisivane krivičnim zakonima nastalima u okviru Jugoslavije. Nastojalo se postići učinkovitije uređenje kazne zatvora uključujući i reformu režima uvjetnog otpusta, preuređenje sustava mjera upozorenja i uvjetne osude, dosljedno uvođenje sustava dnevnih iznosa kod novčane kazne, jačanje uloge i širenja mogućnosti izricanja alternativnih sankcija, te usklađivanje sustava sankcija u Hrvatskoj s međunarodnim dokumentima. Glede kazni za počinitelja moguć je i rad za opće dobro, kao alternativna sankcija koja se sve češće koristi u zapadnoeuropskim zemljama. Kazna zatvora jedna je od najstarijih te za sobom vuče brojne negativne posljedice. Jedna od važnijih stvari koja se zanemaruje su zatvori, kao objekti u kojima zatvorenici izdržavaju svoje kazne.
Abstract (english)
It is a commonly-know fact that punishment covers almost all areas of human life and has an extremely important role in human behavior regulation. Punishment is also an important element in the regulation of social relations within the community. Forms of punishment were developed depending on social structures, moral and value systems. They may have a positive influence on society, but in everday life they are mostly negative, what as such, unfortunately, makes life difficult for the convicts as for their surroundings. This is the reason why the application of alternative sanctions such as probation and work for the public welfare has a positive impact, eg. re-socialization, communtiy benefit, economy, etc. Domain of penalty sanctions is regulated by the Criminal law, which is enacted in 1997 for the first time, and followed by numerous changs and additions, especially regardind the principle of guilt. Efforts have been made to achieve more effective regulation of imprisonment, including reform of the parole regime, alteration of warning measure system and probation, strictly introduction of a daily fines system, giving more importance and expanding ability of imposing alternative sanctions, and aligning the sanctions system in Croatia with international legislation. From the offenders perspective, the best option is work for the public welfare as an alternative sanction increasingly used in Western European countries. Imprisonment is one of the oldest sentences, and it pulls numerous negative consequences. One of the most important things that is neglected are prisons, as facilities where prisoners serve their sentences.
