Abstract
Pravosuđe je u Republici Hrvatskoj neovisno od zakonodavne i izvršne vlasti. Vlast je u Republici Hrvatskoj ustrojena na načelu trodiobe vlasti na zakonodavnu, izvršnu i sudbenu. Sudbeni sustav u Republici Hrvatskoj čine Vrhovni sud koji je ujedno i najviši, slijede ga Županijski i Općinski koji su redovni sudovi, te Prekršajni, Trgovački sudovi, Visoki prekršajni, Visoki trgovački i Upravni sud koji spadaju u grupu specijaliziranih sudova. Glavnu ulogu kod odlučivanja o suglasnosti zakona s Ustavom kao i suglasnosti drugih propisa s Ustavom i zakonom u hrvatskom pravosudnom sustavu ima Ustavni sud. Zakonodavni okvir za sudove u Republici Hrvatskoj čine Ustav Republike Hrvatske i Zakon o sudovima. Važnu ulogu kod imenovanja i razrješenja sudaca ima Državno sudbeno vijeće, dok je detaljno imenovanje i razrješenje sudaca utvrđeno zakonom. U sudbenom sustavu postoji i Državno odvjetništvo koje ima ovlasti i dužnosti postupati protiv počinitelja kaznenih djela.
Abstract (english)
The judiciary is in the Republic of Croatia is in dependent of the legislative and executive authorities. Power in the Republic of Croatia was established on the principle of division of powers in the legislative, executive and judiciary authority. The judiciary system in the Republic of Croatia consists of the Supreme Court, which is at the same time the highest, following the county, municipal which are Ordinary Courts of law, minor offence court, commercial court, high court of minor offences, high commercial court which are courts that are having special jurisdiction. The Constitutional Court has the main role to play in deciding on the conformity of laws with the Constitution and the conformity of other regulations with the Constitution and the Law in the Croatian Judicial System. The legislative framework for courts in the Republic of Croatia is the Constitution of the Republic of Croatia and the Law on Courts. An important role in appointing and dismissing judges is the State Judiciary Council, while the appointment and dismissal of judges is determined in detailby law.In the judicial system there is also a State Attorney's Office which has the authority and duty to prosecute perpetrators of criminal offenses.
