Abstract
Tema ovog diplomskog rada jest „Specifičnosti pravne zaštite u postupcima javne nabave“. Od početaka normativnog uređivanja javne nabave, pa sve do donošenja zadnjeg, trenutno važećeg Zakona o javnoj nabavi ( ZJN 2016) provodilo se potpuno usklađivanje nacionalnog zakonodavnog okvira javne nabave s relevantnim propisima Europske unije. U radu se prvotno analizira javna nabava kroz pojam i ciljeve. Nadalje se izlaže i kratak prikaz razvoja zakonodavnog i institucionalnog okvira sustava javne nabave u Republici Hrvatskoj i Europskoj uniji. Posebni naglasak je upravo na regulaciji sustava pravne zaštite, te novinama sukladno posljednjim izmjenama zakonskih odredbi iz 2016. Naime, za razliku od ranijeg zakona iz 2011.godine, kada se protiv odluke Državne komisije za kontrolu postupaka javne nabave pokretao spor pred Upravnim sudom Republike Hrvatske, sada za istoimene sporove više nije nadležan upravni sud prvog stupnja, već Visoki upravni sud Republike Hrvatske.
Abstract (english)
The theme of this thesis is "Specific features of legal protection in public procurement procedures". From the beginning of the normative regulation of public procurement until the adoption of the last, currently valid Public Procurement Act (LPP 2016), the national legislative framework for public procurement was fully harmonized with the relevant EU regulations. Initially, public procurement is analyzed through terms and objectives. Furthermore, a brief overview of the development of the legislative and institutional framework of the public procurement system in the Republic of Croatia and the European Union is presented. Particular emphasis is placed on legal protection and the latest changes to these legal provisions. Namely, unlike the earlier law, when a dispute was brought against a decision of the State Commission for the Control of Public Procurement Procedures before the Administrative Court of the Republic of Croatia, now the administrative court of the first instance, but the High Administrative Court of the Republic of Croatia, no longer have jurisdiction over the same.
