Abstract
U radu se obrađuje bračni ugovor, kao bitan element uređenja imovinskopravnih odnosa u bračnoj zajednici korištenjem same autonomije volje stranaka, kao i u izvanbračnoj zajednici te istospolnom partnerstvu. U praksi su nerijetke situacije, da čak i uz postojanje zakonske regulacije, stranke ne mogu postići kompromis pri uređenju imovinskopravnih odnosa. A pro po tome, obrazložit ćemo definiciju bračne odnosno partnerske stečevine, vlastite imovine te općenite mogućnosti uređenja imovinskopravnih odnosa bračnih/izvanbračnih drugova te istospolnih zajednica, te u konačnici pokušati približiti institut bračnog ugovora koji je inače većini poznatiji kao predbračni ugovor, što je značajka angloameričkog pravnog sustava. U radu će se također razmotriti najspornija pitanja oko sklapanja bračnog ugovora, mogućnost i potreba za osnivanjem registra bračnih ugovora, te pokušati dati odgovor, zašto i nakon dva desetljeća življenja ovog instituta u RH, ni dan danas nije česta pojava.
Abstract (english)
In this thesis we will dealt with the marriage agreement as an essential element of the regulation of property rights in the marital community, by using the autonomy of the will of the parties, as well as in the extramarital community and the same partner partnership. In practice are often situations, that even with the existence of legal regulation, the parties can not reach a compromise in regulation of property rights. And by doing so, we will explain the definition of marital or partner acquisitions, their own property and general arrangements for regulating the property rights of married / extramarital partners and same-sex communities, and ultimately attempt to approach the institute of marriage contract, which is otherwise mostly known as a pre-contractual agreement, by Angloamerican legal system. The paper discusses the most controversial issues regarding the conclusion of the marriage contract, the possibility and the need of establishing a register of marriage contracts, and at the end, we will try to answer, why even after nearly three decades of existence this institute in Croatia, not even today is not a common occurrence.
