Abstract
Pravo vlasništva temeljni je kamen u bedemu zvanom građanskopravni odnosi, te ga je kao takvog, od iznimne važnosti zaštititi. Tu visoku poziciju, odnosno danu važnost tome pravu njegovalo se daleko u povijesti od rimskog prava na dalje. Temeljno sredstvo (stvarne) pravne zaštite tog instituta je prava vlasnička tužba. U ovom diplomskom radu ćemo se osvrnuti na spomenutu tužbu, propisanu Zakonom o vlasništvu i drugim stvarnim pravima. Tužitelj kao vlasnik preko ovog pravnog instituta zahtjeva povrat stvari od tuženika ili točnije uklanjanje povrede njegova vlasničkog prava, koji je usmjeren protiv osobe koja posjeduje njegovu stvar. Mora se imati na umu da pošteni i nepošteni posjednik imaju različite uloge u postupku te da će se kao takvi različito razmatrati. U radu će se ukratko objasniti i procesni položaj tužitelja kao vlasnika i tuženika kao posjednika, samog tužbenog zahtjeva, dotaknut ćemo se prigovora tuženika te protuzahtjeva. Uz opis odluka suda navedene će biti i određene sudske presude glede zaštite prava vlasništva kod reivindikacije.
Abstract (english)
Ownership rights are the fundamental stone in the foundation of the civil law, and therefore is of the most importance to try to protect that institute. It is from roman times to nowadays that it is put high on pedestal of civil rights. The main tool of (real) legal protection of that institute is real proprietor's lawsuit. In this paper we will take a look at the mentioned lawsuit that is stated in Act on Ownership and Other Real Rights. Prosecutor, as owner, seeks thru this institute of the defendant to return possession of the object of the matter to his (prosecutors) possession or correct the wrong done on his ownership right. We have to have in mind that the honest and dishonest possessors have different roles in the process, and regarding on that fact they will be dealt differently. Thru the paper we’ll briefly explain the legal position of the prosecutor as owner, and defendant as possessor, lawsuit request, complaints of the defendant and counterclaims. Also, with the description of the courts decisions we’ll list few of the decision taken from national legal system regarding the real proprietor's lawsuit – rei vindication.
