Abstract
Predmet ovoga rada vezan je uz teško ubojstvo kao teži oblik ubojstva iz glave protiv života i tijela. Za razliku od običnog ubojstva kao i privilegirajućeg oblika ubojstva, kod teškog ubojstva zakonodavac predviđa teže kažnjavanje. Teže kažnjavanje se veže uz okolnosti pod kojima je počinitelj počinio kazneno djelo teškog ubojstva. Svaka okolnost koja predviđa teže kažnjavanje sadržana je u svakom od oblika teškog ubojstva. Kod podmuklosti i okrutnosti takve okolnosti se ogledaju s obzirom na način počinjenja. Kod niskih pobuda one su vezane uz pobudu, dok se kod posebno ranjivih osoba i prethodno zlostavljanih te službenih osoba okolnosti vežu uz svojstvo objekta zaštite.
Abstract (english)
The subject of this paper is related to aggravated murder as a tough form of murder from the head against life and body. Unlike ordinary murders as well as the privileged form of murder, the legislator foresees more severe punishment for aggravated murder. More severe punishment is linked to the circumstances under which the perpetrator committed the criminal offense of aggravated murder. Every circumstance that foresees more severe punishment is contained in every form of aggravated murder. In terms of brutality and cruelty, such circumstances are reflected in the way of perpetration. In the case of low frustrations, these are related to the low frustrations, while in the case of particularly vulnerable persons and previously abused and the official persons of the circumstances, they are associated with the object of protection.
