Abstract
Na samom početku ovim se radom nastoji ukazati na probleme nastale zbog dvojnosti uređenja vlasništva posebnog dijela nekretnine prije i poslije 1. siječnja 1997. godine. U nastavku se podrobnije razrađuju načini zasnivanja vlasništva na posebnom dijelu nekretnine. Zasnivanje etažnog vlasništva na temelju odgovarajućeg suvlasničkog dijela i izračuna korisnih vrijednosti kao najsloženijeg oblika zasnivanja etažnog vlasništva, zasnivanje na temelju suglasne odluke svih suvlasnika te na temelju očitovanja volje vlasnika zemljišta sa zgradom odnosno nositelja prava građenja sa zgradom. Obrađeni su i objekti na kojima je moguće uspostaviti vlasništvo posebnog dijela. Razrađena i problematika izvršavanja suvlasničkih ovlasti i dužnosti glede posebnog dijela i zajedničkih dijelova nekretnine te upravljanje istom. Na samom kraju ima riječi i o prestanku vlasništva na posebnom dijelu nekretnine.
Abstract (english)
At the very beginning, this paper seeks to point out problems arising from the duality of establishment of ownership of a particular part of real estate before and after 1 January 1997. Below in paper it elaborates on ways of establishment of ownership of a particular part of real estate (condominium ownership). Establishment of ownership of a particular part of real estate (condominium ownership) on the basis of the corresponding co-ownership and calculation of useful values as the most complex form of establishment of condominium ownership, establishment based on the consent of all co-owners and on the basis of the willingness of the owner of the land with the building or the holder of building rights. There are also objects of condominium ownership where it is possible to establish the ownership of a special part that have been discussed in this paper. The issues related to the execution of co-ownership powers and duties regarding the particular part of real estate and objects of condominium ownership of the real estate and the management of the real estate are also elaborated. At the very end, there is talk of termination of ownership of a particular part of real estate.
