Abstract | Tematika ovog diplomskog rada odnosi se na ugovore građanskog prava koji pripadaju u skupinu ugovora o uporabi i korištenju stvari, a to su ugovori o najmu i zakupu. Rad je koncipiran u nekoliko međusobno povezanih tematskih cjelina koje su poredane po logičnom redoslijedu i važnosti. U uvodu su istaknuti osnovni pojmovi – najam i zakup koji su ujedno i tema ovog rada, njihova značenja i temeljne karakteristike. Kroz drugu cjelinu opisan je ugovor o najmu, prava i obveze ugovornih strana – najmodavca i najmoprimca, mogućnost davanja iznajmljene stvari u podnajam i prestanak najma. Kao poseban oblik najma detaljno je opisan ugovor o najmu stana, koji je reguliran Zakonom o najmu stanova, sa svim njegovim koristima i nedostacima. U sklopu ove cjeline nalazi se i ogledni primjer ugovora o najmu stana radi bolje predodžbe kod čitatelja o samom najmu i postupku sklapanja ugovora o najmu stana. Nadalje, sljedeća cjelina je koncentrirana na ugovor o zakupu i njegovim bitnim karakteristikama, ugovornim stranama – zakupodavac i zakupnik, podzakupu i prestanku zakupa. Međutim, postoje posebna uređenja zakupa prema posebnim propisima. U vezi s tim, razlikuju se zakup poslovnog prostora, zakup poljoprivrednog zemljišta, zakup broda, zakup zrakoplova i sl., te su i ovi instituti podrobnije predstavljeni u ovoj cjelini. Također, prikazan je primjer ugovora o zakupu poslovnog prostora. Na koncu ovoga rada povučena je paralela između ugovora o najmu i zakupu, jer iako se radi o ugovorima koji pripadaju istoj skupini ugovora i regulirani su istim propisom – Zakonom o obveznim odnosima, oni sa sobom nose značajne sličnosti, ali i razlike. U zaključku je iznesen osvrt na cjelokupni diplomski rad i objašnjen je sustav prikazanih činjenica, spoznaja i stavova koji su opširnije razrađeni u samom radu. Upravo je glavni cilj i svrha rada naglasiti razliku najma i zakupa, odnosno uporabe i korištenja te probuditi svijest kod ljudi kada trebaju sklopiti ugovor o najmu, a kada ugovor o zakupu. |
Abstract (english) | The topic of this thesis paper refers to the civil law contracts that belong to a group of contracts on use and utilization of objects of property, i.e. rental and lease agreements. This paper is drafted in several interrelated thematic units arranged by logic and relevance. Introduction is about the main terms, - rent and lease, being the topic of this paper, their meaning and fundamental characteristics. The second unit describes the rental agreement, rights and obligations of the contracting parties – the landlord and the tenant ,and the possibility of subletting the rented property and termination of rent. I thoroughly described residential rental agreement, as a special form of rent, regulated by the Law on Residential Rent with all its virtues and faults. Within this unit, there is an illustrative example of a residential rental agreement, provided for a better reader's perspective about the rent and the procedure for concluding a rental agreement. Furthermore, the next unit focuses on the lease agreement and its essential characteristics, on contracting parties, to be more precise, - the lessor and the lessee, sub-lease and the termination of lease. However, there are also special lease arrangements in accordance with special regulations. In that regard, the commercial leasing, agricultural land leasing, chartering, aircraft leasing, etc. All differ, thereby, these instances are also presented in detail in this unit. Also, an example of a commercial lease agreement is provided. At the end of this paper, a parallel between the rental and lease agreement is made, since agreements belong to the same group of contracts and are regulated by the same laws – Law on Contracts and Torts, they share many similarities, but also many significant discrepancies. In the conclusion of the paper a revision of the entire thesis was presented as well as a systematic preview of facts, information and opinions that were elaborated more extensively in the said paper. The main aim and purpose of this paper is to emphasize the difference between rent and lease, i.e. use and utilization, and to raise awareness among people when rental vs. Lease agreements should be concluded. |
