Abstract
Surogat majčinstvo novi je izazov. Postoje različiti stavovi država od onih koje potpuno zabranjuju postupke do onih koje su potpuno liberalne. Razlog tomu mogu se pripisati moralnim i etičkim stavovima država. Upravo iz tih razloga ne postoji propis koji uređuje sva pitanja koja se pojavljuju. Problemi nastaju odmah po rođenju djeteta. Djetetu ne možemo odrediti državljanstvo, ne možemo odrediti prave roditelje. Onda dolazi do izdvajanja djeteta iz obitelji koji otvaraju niz novih problema. U radu će se obraditi stara i nova praksa Europskog suda za ljudska prava i Suda Europske unije. Isto tako, kada govorimo o surogat majčinstvu moramo spomenuti ljudska prava koja se odnose na sve sudionike od surogat majke, namjeravanih roditelja, djeteta pa do donatora stanice ukoliko namjeravani roditelji nisu biološki roditelji djeteta. Rješenja predlažu svi: akademski stručnjaci i međunarodne organizacije. Što se pak tiče Republike Hrvatske, ona ne regulira samo pitanje surogacije već njezinu zabrano možemo iščitati iz odredbi Obiteljskog i Kaznenog zakona.
Abstract (english)
Surrogacy is a new challenge. There are different attitudes of states than those who completely banned the proceedings to those who are completely liberal. The reason for this can be attributed to the moral and ethical attitudes of states. Precisely for these reasons, there is no regulation regulating all issues that arise. Problems occur immediately upon the birth of the child. We can not determine a child's citizenship, we can not determine the right parents. Then there is the separation of a family child who opens a series of new problems. This paper will deal with the old and new practice of the European Court of Human Rights and the Court of the European Union. Likewise, when talking about the suicide of maternity, we must mention the human rights that apply to all the participants of the surrogate mother, the intended parents, the child and the donor of the cell if the intended parents are not the biological parents of the child. Solutions are proposed by all: academics and international organizations. As far as the Republic of Croatia is concerned, it does not only regulate the issue of surogance, but its forbidden can be read from the provisions of the Family and Criminal Code.
