Abstract Trenutno važeći Zakon o upravnim sporovima inkorporira u sebi dva izvanredna pravna lijeka: Zahtjev za izvanredno preispitivanje zakonitosti pravomoćne presude (u daljnjem tekstu: zahtjev) i Obnovu spora, koja su zbog nestručosti te nepovezivanja sudske prakse i zakonskog teksta, podnormirana. Problematizira se isključiva legitimacija Državnog odvjetništva Republike Hrvatske (u daljnjem tekstu: DORH) za podnošenje zahtjeva, bilo ex offo ili po prijedlogu stranke zbog povrede postupovnih i materijalnih pitanja, nenadležnosti i pogrešno ili nepotpuno utvrđenog činjeničnog stanja. Izlažu se moguća nomotehnička poboljšanja usmjerena ka izravnom stranačkom podnošenju zahtjeva, čime bi se zasigurno više opteretio Vrhovni sud Republike Hrvatske (u daljnjem tekstu: VSRH), ali i osnažila jedinstvena primjena prava i ravnopravnost svih u njegovoj primjeni, što je i svrha postupanja navedenog suda putem kasatornih i reformacijskih odluka o zahtjevu. Analizira se praksa nadležnog suda o zahtjevu za razdoblje od 2012-2017. godine putem baze podataka/sustava za objavljivanje sudskih odluka “SupraNova“ te informacija izravno prikupljenih od strane DORH-a i VSRH. Uočava se kako je sudska praksa po zahtjevu znatno jednolična, malen je broj pozitivnih odluka o zahtjevu, što je alarm da su potrebna nova zakonodavna rješenja o istome. Obrazložen je i korektiv nemogućnosti isticanja zahtjeva protiv odluka Visokog upravnog suda Republike Hrvatske(u daljnjem tekstu: VUS) u upravnom sporu ocjene zakonitosti općeg akta. S druge strane, obnova je dopuštena samo glede spora okončanog prvostupanjskom ili drugostupanjskom presudom, i to iz 7 razloga koji su na raspolaganju strankama. Spor je često okončan i rješenjem, pa se detaljno kritizira ovakav propust zakonodavca, što praktično ne predstavlja prepreku. Prednost obnove spora prema zahtjevu je u tome što je sadržaj prijedloga jasan za razliku od posebnog podneska stranke DORH-u, ali i samoga zahtjeva. Razmatra se početak roka za podnošenje prijedloga za obnovu spora, što glede pojedinih razloga predstavlja izniman praktični problem, kao i postupak te široke ovlasti odlučivanja nadležnog suda o prijedlogu. Istaknute poroznosti članaka 76 - 78. zasigurno će biti predmet slijedeće izmjene i dopune ZUS-a, u kojoj ne treba začuditi pronalazak rješenja navedenih i obrazloženih u ovome radu.
Abstract (english) The existing Administrative Dispute Act offers two exclusive legal remedies: The Request for extraordinary review of the legality of the judgment that is final and enforceable and Dispute review, which are due to lack of competence and ability to connect the case law with the legislation, insufficiently regulated. The thesis questions the exclusive legitimacy of State Attorney's Office for filing the Request, either ex offo or upon request of the parties, because of the procedural and substantive issues infringement, incompetence and wrong or incomplete facts. Furthermore, it deals with possible nomotechnical improvements aimed at direct submitting of the Request by the parties, which, although being an additionally burden to the Croatian Supreme Court, would also inprove the uniform application of law and equality of the parties involved; this is the purpose of this Court by way of passing cassation and reformation decisions on the request. Furthermore, the thesis gives an analysis of the practice of the competent Court on the request in the period from 2012 to 2017 by means of database/system for publishing court decisions, “SupraNova“ and directly collected data of the State Attorney's Office and the Croatian Supreme Court. It can be noted that case law on the request is uniform, and that there is a small number of positive decisions on the request, which is an alarm that requires new legislative solutions. The paper also gives explanations for the correction of the impossibility to file the request against the decisions of the Croatian High Administrative Court in an administrative dispute for assessing the legality of the general act. On the other hand, the review is allowed only in disputes solved by the first-instance or second-instance judgment, under the condition that the parties meet seven requirements. Since the dispute is often resolved in passing a decision, the thesis indicates detailed criticism of these omission by the legislator, although in practice it is not an obstacle. The advantage of the dispute review in relation to the request is that the content of the proposal is clear unlike a special submissions of the party to State Attorney's Office, and the request itself. The thesis deals with the commencement of the deadline for the submission of proposals for dispute review, which for some reasons poses a huge problem in practice, as well as the proceedings and considerable powers of the competent court in passing a decision. The possible porosity of articles 76-78 shall certainly be subject to future amendments of the Administrative Dispute Act, and it should not be a surprise that solutions thereto are found as listed and laid down in this paper.
