Abstract
Diplomski rad pod nazivom „Zaštita prava vlasništva u sudskom postupku“ ima ukupno XI. dijelova te 40 stranica teksta. U uvodnom dijelu napomenuto je kako je predmet diplomskog rada usmjeren na načine ostvarivanja zaštite prava vlasništva i to u isključivo sudskom postupku koju vlasnik ostvaruje kao ovlaštenik stvarnog prava. U drugom dijelu prikazana su obilježja prava vlasništva kao jednog od temeljnog prava čovjeka te na koje načine jamstvo prava vlasništva daju Ustav Republike Hrvatske i međunarodni dokumenti. Nakon toga, u trećem i četvrtom dijelu naveden je kratki povijesni pregled ostvarivanja zaštite prava vlasništva u rimskom pravu kao i prema Općem građanskom zakoniku koji je bio na snazi u hrvatskim zemljama u 19. stoljeću. U petom dijelu navedeni su načini ostvarivanja zaštite prava vlasništva u parničnom postupku povodom različitih vlasničkih tužbi kojima vlasnik može zaštititi svoje pravo vlasništva. Šesti dio diplomskog rada odnosi se na pravo vlasništva u svjetlu odredbe članka 1. Protokola broj I. uz Europsku konvenciju za zaštitu ljudskih prava i temeljnih sloboda, a sedmi dio prikazuje praksu i temeljna pravna stajališta Europskog suda za ljudska prava kao i odluke istog, vezane za povredu ranije navedenog članka u odnosu na Republiku Hrvatsku. Na samom kraju diplomskog rada, obrađuje se praksa Ustavnog i Upravnog suda Republike Hrvatske te se navode njihova najvažnija pravna stajališta u predmetima koji su vezani za povredu prava vlasništva. Konačno, u zaključku se ukratko sumiraju ključne postavke na kojima se diplomski rad temelji te se analiziraju relevantne činjenice koje su obrađene i iznesene u sklopu ovoga diplomskog rada.
Abstract (english)
Master’s thesis titled „The Protection of the Property Right in Court Proceedings“ consists of XI. parts and 40 pages of text. In the introductory part, it is mentioned that the subject of the master’s thesis is focused on ways of achieving the protection of the property right exclusively in court proceedings. The second part describes characteristics of the property right as one of the fundamental human rights and how the Croatian Constitution and international documents guarantee of the property right. After that, in the third and the fourth part, a brief historical review of the realization of the protection of property right according to Roman law is given as well as according to General Civil Code, which was in force in the 19th century in Croatian countries. The fifth part describes ways of achieving the civil protection of property right in court proceedings regarding ownership claims. The sixth part of the master’s thesis refers to the property right in the sense of Article 1. of Protocol No. I. of European Convention for the Protection of Human Rights and Fundamental Freedoms, while the seventh part presents the practice and fundamental legal opinions of the European Court of Human Rights and some cases which refer to the Republic of Croatia. At the end of the master’s thesis, main opinions in the practice of the Constitutional and Administrative Court of the Republic of Croatia which are related to a violation of the property right, are summarized. Finally, the conclusion reviews the key concepts on which the master’s thesis is based on, and it analyses the relevant facts which have been elaborated and presented in this thesis.
