Abstract
Ovaj diplomski rad detaljno obrazlaže temu stvarnih prava na brodu u Republici Hrvatskoj. Stvarna prava, najjednostavnije rečeno, su skup pravila građanskoga prava koja reguliraju pripadanje stvari osobama. Pod stvarnim pravima podrazumijevaju se pravo vlasništva na brodu (rad spominje i suvlasništvo), hipoteka ( i razlike prema mortgage-u), te pomorski privilegiji. Nadalje, u prvom dijelu rada, napravljen je kratki povijesni pregled tijeka razvoja stvarnih prava. Republika Hrvatska ratificiranjem međunarodnih konvencija poneke institute stvarnih prava (primjerice hipoteku) uređuje po uzoru na praksu common law zemalja.
Abstract (english)
This diploma paper, in a very detailed way, explains the topic of propriety rights on a ship in the Republic of Croatia. Propriety rights, in simple terms said, contain rules of civil rights, wich regulate the belongings of things to a person. Propriety rights include the right of ownership on a boat ( co-ownership is also mentioned in the paper), hypotheque (paper explains differences versus mortgage) and also maritime privileges. Furthermore, in the first part of the paper, a brief historical overview of the course of the development of property rights, has been made. The Republic of Croatia, throughout the process of ratifying international conventions, some of the institutes of propriety rights (for example hypotheque), has arranged very similar to the practice of the common law countries.
