Each act of murder has its own object, method and incentive, but not every murder is equally wrong nor contains the same criminal content. Therefore it is necessary to set the criteria for judging when the act of murder – due to the circumstances in which it was committed - no longer constitutes an ordinary murder but its more severe form which entails more severe punishment. These criteria must also be enforceable in order to achieve righteousness and the purpose of punishment. Severe murder is a qualified form of murder characterized by the realization of qualifying circumstances. Those circumstances are part of the being of the criminal act and refer to: the incentives for committing the criminal offense – self-interest, reckless revenge, hatred, and other primarily low motives; the act of murder for the purpose of perpetration or concealment of another criminal offense; the way of committing an act - cruel or insidious; the characteristics of the object of the act - the murder of a person particularly vulnerable due to their age, severe physical or mental impairment or pregnancy; the murder of a person previously abused by a perpetrator; and the murder of an official in connection with their official duty. The qualifying circumstances of a severe murder are explicitly provided by Article 111 of the Criminal Code passed on October 21, 2011 which entered into force on January 1, 2013. This law replaced the Criminal Law which had been in force since January 1, 1998 and which had also regulated the criminal offense of severe murder. The comparison of the qualifying circumstances, as regulated by the past and the present law, suggests that certain modifications are introduced as necessary and justified, but equally: that altering the content of a criminal offense can be unjustified and to the detriment of legal well-being.
