Abstract
U radu se pobliže analizira odgovornost pomorskog prijevoznika u prijevozu stvari morem kroz odredbe međunarodnih konvencija te Pomorskog zakonika. Pitanje odgovornosti prijevoznika jedno je od najvažnijih pitanja u pomorskoj grani te je bitno razgraničiti i određene pojmove vezane za sam ugovor o prijevozu. Kod odgovornosti prijevoznika veliku važnost zauzima temelj odgovornosti. Gledajući donešene konvencije može se zamijetiti kako se kao kriterij uzima pretpostavljena krivnja. Posebnu pažnju zauzima i institut ograničenja odgovornosti prijevoznika koji prvenstveno služi zaštiti samog prijevoznika od prevelike štete.
Abstract (english)
The paper analyzes the responsibility of maritime carriers in carrying goods through the provisions of international conventions and the Croatian Maritime Code. The issue of carrier liability is one of the most important issues in the maritime domain and it is also essential to define certain concepts related to the transport contract itself. In the responsibility of carriers, the basis of responsibility is of great importance. Looking at the conventions made it can be noticed that the criterion assumes presumed culpability. Special attention is also given to the institute of limitation of carrier responsibility, which primarily serves to protect the carrier from too much damage.
