Abstract
U ovom radu opisan je proces razvoja šerijatskog prava u kontekstu nastanka i širenja islama, uzimajući u obzir vremensko razdoblje i geografski prostor početnog širenja ovog vjerskog i s njime povezanog pravnog sustava. Također se dotiče primjene i utjecaja šerijatskog prava na pravne sustave na području Hrvatske i susjednih država tijekom povijesti .Objašnjen je položaja žena u šerijatskom pravu na počecima njegova postojanja, kao i aspekti njegove suvremene primjene, posebice privatnopravni položaj u šerijatu s naglaskom na sklapanje braka i razvod, nasljeđivanje, obrazovanje i rad, slobodu kretanja i odijevanja, očuvanje čistoće(nevinosti). Kaznenopravni položaj žena obuhvaćen je kategorizacijom zločina i pripadajućih kazni te je podrobnije objašnjeno nasilje i strogost istih. Sve navedeno popraćeno primjerima iz područja primjene šerijatskog prava, u svrhu boljeg prikaza današnjeg stanja stvari. Rad se osvrće i na borbu za prava žena i pokušaje poboljšanja tog položaja žena u muslimanskim društvima suvremenog svijeta.
Abstract (english)
This diploma paper describes the process of development of Sharia law in the context of the emergence and spread of Islam, taking into account the time period and geographical space of the initial spread of this religious and related legal system. It also touches on the application and influence of Sharia law on the legal systems in the territory of Croatia and neighboring countries throughout history. It explains the position of women in Sharia law at the beginning of its existence, as well as aspects of its modern application, in particular the private position of women in Sharia, with an emphasis on marriage and divorce, inheritance, education and work, freedom of movement and clothing, preservation of chastity (innocence). The position of women in criminal law is covered by the categorization of crimes and the corresponding penalties and the violence and severity of the same are explained in more detail. All of this is accompanied by examples from the field of Sharia law, in order to better illustrate the current state of affairs. The diploma paper also reflects on the struggle for women's rights and attempts to improve the position of women in the Muslim societies of the modern world.
