Abstract
Dječji brak, poznat kao rani brak ili prisilni brak, označava praksu u kojoj maloljetne osobe ispod zakonom propisane dobi za sklapanje braka, sklapaju braka, najčešće pod prisilom. Dječji brak prisutan je u zemljama širom svijeta i problem je koji se tiče svih nas. Svako dijete predstavlja ljudsko biće koje još nije navršilo svoju punoljetnost, odnosno 18 godina života, osim ako se zakonom koji se primjenjuje na dijete granica punoljetnosti ne odredi ranije. Navedeno pravno određenje pojma djeteta dala je i prva precizirala Konvencija o pravima djeteta Ujedinjenih naroda. Dječji brak predstavlja velik problem, kojeg nastoji riješiti međunarodna zajednica i države, donoseći brojne propise, mjere i strategije radi uklanjanja istog. Kao glavni uzroci dječjeg braka navodi se siromaštvo, nedostatak obrazovanja, ekonomska situacija te kulturne norme, vrijednosti i tradicija unutar određene zajednice. Indija nastoji suzbiti praksu dječjeg braka kroz vlastite propise i mjere, te kroz suradnju s međunarodnom zajednicom.
Abstract (english)
Child marriage, as known as an early marriage or forced marriage, denotes practices in which minors below the compulsatory age needed for marrying someone are mostly getting married under duress. Child marriage is present in most worldwide countries and it is a problem concerning every individual. Every child represents a human being who is still a minor and under the 18 years of age or on the other hand, if the legal age limit is below that age. Previously written, the legal determination of a child was firstly given in the Convention on the Rights of the Child by the United Nations. Chlid marriage represents a huge problem, which is trying to be solved by the international community and other countries by enroling various regulations, measurements and strategies. The main causes of child marriages are: poverty, the lack of education, economic states of cultural norms, values and traditions in different communities. India is trying to supress the practice throughuot it's own regulations and measurements and while cooperatiing with the international community.
