Over a certain period of time, specifically from 2005 until today, Croatian legislation has undergone many changes and amendments to the Enforcement Act. These changes pertain to the expansion of public notary authority in realizing claims through payment orders, as well as proposals for enforcement based on authentic instruments. This thesis analyzes the concept of a payment order, its types, and the normative presentation of the double system of regulation through the Civil Procedure Act and the Enforcement Act. It also examines the judicial interpretation of the European Court of Justice in cases of Zulfikarpašić and Pula parking d.o.o., which discuss the role of public notaries in enforcement proceedings. Additionally, with the latest amendments to the Enforcement Act from 2020, public notaries now act as court commissioners. Moreover, the thesis analyzes new ways of electronically issuing payment orders and discusses the fees and costs of public notaries in enforcement proceedings related to proposals for enforcement based on authentic instruments. The aim of this thesis is to analyze various aspects of payment orders and the role of public notaries in enforcement proceedings in Croatia, providing an overview of the current state, new legal amendments, and judicial rulings that affect this process.
