Abstract
Oporuka je pravni temelj nasljeđivanja, odnosno osobno i jednostrano očitovanje oporučiteljeve posljednje volje koje je usmjereno na raspolaganje njegovom imovinom za slučaj smrti. Temeljni propis koji uređuje oporuku i njezine vrste je Zakon o nasljeđivanju. U radu su definirani općeniti pojmovi oporučnog nasljeđivanja, a naglasak je stavljen na samu oporuku kao i na njezine vrste. U hrvatskom pravnom sustavu postoje tri temeljne vrste oporuka, a to su privatne oporuke, javne oporuke te oporuke u izvanrednim okolnostima (usmena oporuka). U radu su detaljno razrađene temeljne vrste oporuka kao i njezine podvrste, navedene su temeljne definicije kao i primjeri predmeta iz sudske prakse. U svrhu rada provedeno je istraživanje u obliku ankete sa ciljem uvida u poznavanje osnovnih pojmova oporučnog nasljeđivanja te oporuke kao njezina temelja u hrvatskom pravu. Anketno istraživanje je analizirano na samom kraju rada.
Abstract (english)
The will is the legal basis for the inheritance, i.e. the personal and unilateral manifestation of the testator's last will, which is directed at the disposal of his property int he event of death. The basic legislation governing the will and its kind is the inheritance Act. General terms of the will inheritance are defined in the paper, and emphasis is placed on the will itself as well as on its species. There are three basic types of wills int he Croatian legal system, namely private wills, public wills and wills in extraordinary circumstances (oral will). The paper elaborates in detail the basic types of wills as well as their subtypes, provides basic definitions as well as numerous examples of cases from case-law. For the purpose oft the work, a survey was conducted with the aim of insight into the basic concepts of the will inheritance and the will as its basis in Croatian law. The survey was analyzed at the very end of the paper.
