Abstract
Ekonomski aspekt braka prepoznaje ne samo hrvatski zakonodavac, nego i zakonodavci diljem svijeta. Upravo zbog navedenog države uspostavljaju skup pravnih pravila koja reguliraju imovinske odnose u braku. Ipak, bračnim se drugovima daje i mogućnost sklapanja bračnog ugovora kojim će u potpunosti ili djelomično otkloniti primjenu zakonskih pravila. Bračni je ugovor hrvatskome pravu poznat već dugi niz godina, a bračni drugovi u Republici Hrvatskoj imaju gotovo neograničenu slobodu pri kreiranju njihovog vlastitog bračnoimovinog režima. Međutim, ipak je potrebo pridržavati se granica određenih prisilnim propisima i moralom društva. S obzirom da sklapanje bračnog ugovora može biti od iznimne koristi za bračne drugove, cilj je ovog rada prikazati zakonodavni okvir kojim se uređuje bračni ugovor u Republici Hrvatskoj te ukazati na potencijalne probleme koji se ističu u pravnoj literaturi. Osim navedenog u radu se daje osvrt na pravna pravila odabranih komparativnih sustava s ciljem usporedbe istih s rješenjima hrvatskoga zakonodavca.
Abstract (english)
The economic aspect of marriage is recognized not only by the Croatian legislator, but also by legislators all around the world. For this reason states establish a set of rules that regulate property relations between spouses. However, spouses also have an option to enter into a marital agreement and completely or partially remove rules set by their national law. The matrial agreements between spouses exist in Croatian Law for many years now. Spouses in Croatia have almost unlimited freedom to shape their own property relations. However, a contractual freedom can not be fully unlimited. Namely, the marital agreement between spouses can not be contrary to morality or public policy. This Diploma paper analyzes legal framework of Croatian's Family Law regarding the contractual freedom in marriage. Also, the aim is to point out problems regarding marital agreements between spouses in practice. Finally this paper provides a short overview of the legal rules of selected comparative european legal systems, and comparing this rules with the solutions of the Croatian legislator.
