Abstract | Objektivna odgovornost ili odgovornost bez krivnje u današnjim uvjetima rada medicinske struke, a posebno kirurške, u trendu je drastičnog povećanja, te je sve aktualnije širenje polja primjene ove vrste odgovornosti. Trenutno se temelji na Zakonu o obveznim odnosima koji je iznimno širok, pa spada i u medicinske propise iako u njemu nema ni riječi o medicinskoj šteti i štetnoj odgovornosti. On trenutno služi kao supstitut građanskom zakonu koji u Hrvatskoj ne postoji za razliku od razvijenih zemalja Europe koje ga imaju. Objektivna odgovornost predstavlja teži oblik odgovornosti jer se odgovara samo na temelju činjenice da je nastala šteta, ne uzimajući u obzir subjektivni element krivnje u takvoj radnji. Za liječnike, posebno kirurge, to predstavlja veliki moralni i financijski problem s obzirom da se medicinska struka znatno razvija posljednjih godina, te su sve češće u primjeni roboti na čiji rad i greške ponekad liječnici ne mogu utjecati. Upravo zato, objektivna odgovornost kao najteži oblik odgovornosti nepravedno se primjenjuje na liječnike. Ovim radom želim aktualizirati gorući problem i ukazati na hitnost potrebe političke volje da se pristupi pripremi i donošenju tog zakona i specijalnih medicinskih pravnih normi, uz sudjelovanje svih zainteresiranih strana, uključujući svakako znanost. Time bi se riješio veliki broj nagomilanih problema u medicinskoj struci koji su glavni razlog egzodusa traumatizirane medicinske struke, posebno kirurga, a kao posljedica toga i sve većeg broja nezadovoljnih pacijenata koji ostaju bez adekvatne medicinske pomoći. |
Abstract (english) | Objective liability or no-fault liability in today’s working conditions of the medical profession, especially surgery, is experiencing a drastic increase, and the expansion of the field of application of this type of liability is becoming more and more relevant. Currently, it is based on the Law on Obligatory Relations, which is extremely broad, so it also falls under medical regulations, although there is not even a word in it about medical damage and damage liability. It currently serves as a substitute for the Civil Code, which does not exist in Croatia, as opposed to the developed countries of Europe, which do have it. Objective liability is a more severe form of liability because it only applies based on the occurrence of damage, without taking into account the subjective element of guilt in such an action. For doctors, especially surgeons, this represents a big moral and financial problem, given that the medical profession has been developing significantly in recent years, and robots are increasingly being used, whose work and mistakes sometimes cannot be influenced by doctors. Precisely because of this, objective liability as the most severe form of liability is unfairly applied to doctors. With this thesis, I want to bring attention to this burning problem and point out the urgency of the need for political will to approach the preparation and adoption of this law and special medical legal norms, with the participation of all interested parties, including science. This would solve a large number of accumulated problems in the medical profession, which are the main reason for the exodus of traumatized medical professionals, especially surgeons, and, as a consequence, an increasing number of dissatisfied patients who are left without adequate medical assistance. |
