Abstract
Tema ovog završnog rada su služnosti. Služnosti čine pravni institut koji omogućava ovlašteniku da koristi tuđu stvar u određene svrhe, a da pri tome ne postane njezinim vlasnikom, a sve to dok je vlasnik te stvari u obvezi takvo činjenje trpjeti ili propuštati. Sve služnosti imaju većinu zajedničkih karakteristika, poput toga da su stvarna prava ili da su na tuđoj stvari ili da su neprenosiva prava i slično. Upravo zbog te činjenice sve služnosti su uređene Zakonom o vlasništvu i drugim... More stvarnim pravima, a koji je još i temeljni izvor ovog rada. Služnosti se, u praksi, najčešće uspostavljaju radi prolaza ili prolaza i priključka na javnu infrastrukturu, primjerice poput vodovoda ili električne mreže. Međutim, one se mogu uspostaviti i u druge svrhe, poput prava korištenja zemljišta za poljoprivredu, pravo ribolova na nekom vodnom području i tako dalje. U ovome završnom radu bilo je potrebno istražiti kako su služnosti bile regulirane u rimskom pravu, a zatim i kako su one uređene putem zakonske regulative danas. Nadalje, u ovome radu objasnila sam detaljno svaku pojedinu vrstu služnosti i njihove podvrste. Od bitnog značaja bilo je i analizirati sam postupak stjecanja, odnosno osnivanja samih služnosti te naglasiti i putem kojih se sve pravnih temelja služnosti mogu uspostaviti. Na samom kraju, navela sam i načine kojima se može štititi pravo služnosti te na koje sve načine može prestati pravo služnosti. Less
Abstract (english)
The topic of this final paper are servitudes. Servitudes are a legal institute that enables the authorized person to use someone else's thing for certain purposes, without becoming its owner, and all this while owner of that thing is obliged to suffer or forbear doing so. All servitudes have most common characteristics, such as being real rights or being on someone else's property or being non-transferable rights and the like. Precisely because of this fact, all servitudes are regulated... More by the Law on Property and Other Real Rights, which is also the fundamental source of this work. Servitudes are, in practice, most often established for the purpose of passage or passage and connection to public infrastructure, for example, such as water supply or electrical grid. However, they can also be established for other purpose, such as the right to use land for agriculture, the right to fish in a water area, and so on. In this final paper, it was necessary to investigate how servitudes were regulated in Roman law, and then how they are regulated through legal regulations today. Furthermore, in this paper I have explained in detail each individual type of servitudes and their subtypes. It was also of great importance to analyze the process of acquiring, that is, the establishments of the servitudes themselves, and to emphasize the means by which all the legal foundations of the servitudes can be established. At the very and, I listed the ways in which the right of servitudes can be protected and the ways in which this right can be terminated. Less
