Abstract
Osobe s invaliditetom pripadaju jednoj od najranjivijih skupina kojoj je potrebna posebna zaštita države i društva. Poslovna sposobnost omogućuje nam da stvaramo pravne učinke i donosimo odluke vezane uz naš život, a osobama s invaliditetom to je svojstvo, najčešće, ograničeno. Rad je usmjeren na probleme s kojima se osobe s invaliditetom susreću kada je u pitanju institut skrbništva i na pojedine odredbe sadržane u Konvenciji o pravima osoba s invaliditetom te u Obiteljskom zakonu Republike... More Hrvatske. Konvencija o pravima osoba s invaliditetom temeljni je dokument koji sadrži odredbe čiji je cilj zaštita temeljnih prava osoba s invaliditetom, no primjena tih odredbi često nije tako lako provediva u praksi. Rad prikazuje i raskorak između odredbi Obiteljskog zakona i onoga što nalaže Konvencija o pravima osoba s invaliditetom, a usmjeren je i na problematiku potpunog ukidanja lišenja poslovne sposobnosti. Kada je u pitanju autonomija osoba s invaliditetom u donošenju životno važnih odluka, zamjenski režim odlučivanja potrebno je zamijeniti odlučivanjem uz podršku kako bi se osobama s invaliditetom omogućilo uživanje ljudskih prava na jednakoj osnovi s drugima. Posebice se ističe uloga centra za socijalnu skrb koji ima veliku ulogu u samom institutu skrbništva, rada sa štićenicima i njihovim obiteljima te osnaživanju osoba s invaliditetom u vidu jačanja njihovih kapaciteta i time stvaranja autonomije i samostalnosti. People with disabilities belong to one of the most vulnerable groups that need special protection from the state and society. Business ability allows us to create legal effects and make decisions related to our life, and for a person with a disability, this property is usually limited. The work is focused on the problems faced by persons with disabilities when it comes to the institution of guardianship and on certain provisions contained in the Convention on the Rights of Persons with... More Disabilities in the Family Law of the Republic of Croatia. The Convention on the Rights of Persons with Disabilities is a fundamental document that contains provisions aimed at protecting the fundamental rights of persons with disabilities, but the application of these provisions is often not so easily implemented in practice. This paper also shows the gap between the provisions of the Family Law and what is required by the Convention on the Rights of Persons with Disabilities, and it is also focused on the issue of abolishing the complete deprivation of business capacity. When it comes to the autonomy of people with disabilities in making life-important decisions, the substitute decision-making regime needs to be replaced by supported decision-making in order to enable a person with a disability to enjoy human rights on an equal basis with others. Social services play a major role in the institution of guardianship in work with residents and their families, and the empowerment of people with disabilities in the form of strengthening their capacities and the creation of autonomy and independence.
