Abstract
Prikazuje se kroz zakonsko uređenje,odgovornost za neispravan proizvod kao podvrsta općeg instituta odgovornosti za štetu, definirajući tko se sve smatra proizvođačem, oštećenikom, što je to proizvod, specifične vrste proizvoda i posebno neispravan proizvod. U radu se razrađuju i pretpostavke čije se ispunjenje zahtijeva za nastanak ove vrste odgovornosti, koje su specifične kao i sam ovaj institut odgovornosti za štetu. Ukratko se prikazuju pravila kojima je uređena odgovornost za neispravan proizvod s pravilima koja reguliraju druge vrste odgovornosti, čime se pojašnjava razlog posebne regulative ove vrste odgovornosti. Navodi se i nekoliko slučajeva iz sudske prakse, što domaće, što strane, čime se potkrepljuje sve teorijski izneseno o ovom institutu odgovornosti za štetu.
Abstract (english)
Through legislative regulations the legal responsability for defective products is shown here as a subset of the general institution of liability for demages, defining who is considered as a manufacturer or an injured party, what a product is, specific types of products and particularly a defective product. The paper also elaborates the preconditions, whose fulfilment is essential for the emergence of this kind of responsability, which are specific, and so is this institution of liability for demages. It summarizes the rules governing the legal responsibilities for defective products in regulation to the rules governing other types of legal responsibilities, by which explains the need for specific regulations for this kind of legal responsibilities. A few cases of judicial practice, both national and foreign, have also been cited, by which everything presented theoretically about the institution of liability for demages shall be supported.
