Abstract
U radu se izlažu posebne dokazne radnje u kaznenom postupku prema Zakonu o kaznenom postupku s naglaskom na opravdanost provođenja radnji u odnosu na ograničenja temeljnih ljudskih prava i sloboda. Suprotstavljajući težnju države da počinitelja uhvati i kazni, te težnju da se sačuva privatnost svake osobe, a budući da se primjenom posebnih dokaznih radnji u kaznenom postupku, u manjoj ili većoj mjeri, uvijek zadire u privatnost osobe prema kojoj se posebne dokazne radnje provode, zakonska osnova za provođenje posebnih dokaznih radnji te formalne i materijalne pretpostavke koje se moraju ispuniti prilikom donošenja naloga za provođenje posebnih dokaznih radnji, vrlo su bitan element ovoga diplomskoga rada. Svaka posebna dokazna radnja, kao i osnove za njezino provođenje, detaljno su objašnjene u ovome diplomskom radu.
Abstract (english)
This diploma paper presents special investigative techniques in criminal proceedings according to the Criminal Procedure Act with an emphasis on the justification of actions in relation to restrictions on fundamental human rights and freedoms. Opposing the state's desire to catch and punish the perpetrator and the desire to preserve the privacy of each person, and since the application of special investigative techniques in criminal proceedings, to a greater or lesser extent, always invades the privacy of the person against whom special investigative techniques are carried out, the legal the basis for conducting special investigative techniques and the formal and material assumptions that must be met when issuing an order for conducting special investigative techniques are a very important element of this diploma paper. Each special investigative technique, as well as the basis for its implementation, are explained in detail in this diploma paper.
