Abstract
Od raznih alternativnih načina rješavanja sporova izdvojit ćemo mirenje koje unatoč brojnim prednostima, ipak nije prvi izbor sudionicima sporova. Rad se može promatrati kroz tri dijela. Prvi dio odnosi se na općenite pojmove o mirenju što uključuje temeljna načela mirenja, povijesni razvoj instituta kao i sam tijek postupka opisan u skladu sa Zakonom o mirenju koji je, uz brojne druge zakone, najzastupljeniji u radu. Drugi dio rada čine slučajevi obveznog mirenja u Republici Hrvatskoj. Kao jedan od najčešćih te potencijalno i najkorisniji slučaj obveznog mirenja navodi se mirenje u obiteljskim sporovima. Ono je detaljnije obrađeno te predstavlja treći dio rada. Dodatno je prošireno s odredbama o obiteljskoj medijaciji. Također se navode i sporovi u kojima mirenje zakonski nije obvezno ali bi bilo poželjno njegovo provođenje. Kroz cijeli rad nastoji se ukazati na razne prednosti mirenja koje bi trebale pomoći u tome da se shvati zašto je u pojedinim slučajevima mirenje obvezno, opravdano pa čak i nužno. Zakonodavna vlast, sudovi, odvjetnici i drugi pravni stručnjaci donošenjem zakona, pravilnika i drugih akata rade na tome da mirenje postane prihvaćeno i u praksi.
Abstract (english)
From the various alternative ways of resolving disputes, we will single out mediation, which, despite its numerous advantages, is still not the first choice for participants in disputes. Present paper can be observe in three parts. The first part refers to the general terms of mediation, the historical development of the institute, as well as the course of the procedure described in accordance with the Law on Conciliation, which, along with numerous other laws, is the most represented in the paper. The second part of the paper consists of cases of mandatory mediation in the Republic of Croatia. Conciliation in family disputes is mentioned as one of the most common and potentially the most useful cases of mandatory mediation. It's processed in more detail and represents the third part of the paper. There are also disputes in which conciliation is not legally mandatory, but its implementation would be desirable. Throughout the whole paper, various advantages of mediation are pointed out, which should help in understanding why in certain cases mediation is mandatory, justified and even necessary. The legislative authority, courts, lawyers as other legal experts, by passing laws, regulations and other acts, make efforts to ensure that reconciliation becomes accepted in practice.
