Abstract
U ovom diplomskom radu cilj je prezentirati europski nalog za blokadu računa, a koji je reguliran Uredbom Europskog parlamenta i Vijeća (EU) br. 655/2014 od 15. svibnja 2014. o uspostavi postupka za europski nalog za blokadu računa. Uredbom 655/2014 nastoji se uspostaviti postupak naloga kako bi se pojednostavila prekogranična naplata duga u građanskim i trgovačkim stvarima. Glavna svrha naloga je zamrzivanje dužnikovih sredstava na vlastitom računu radi isplaćivanja tražbine vjerovniku. Nalog mora sadržavati određeni oblik, imati određeni sadržaj i sve potrebne isprave koje se navode u Uredbi 655/2014. Blokada može trajati dok se ne opozove ili dok se ne prekine izvršenje naloga. Svaki subjekt u postupku ima pravu na žalbu koju mora podnijeti u navedenim rokovima. Ako dužnik ima više računa sa kojih se treba naplatiti vjerovnika odredit će se raspored naplate. U radu će se razmotriti situacije u kojima se nalog može primijeniti, njegove funkcije, posljedice provedbe te predstaviti subjekti koji mogu biti zahvaćeni nalogom.
Abstract (english)
This thesis aims to give an idea of the European order for freezing the accounts, which is regulated by the Regulation (EU) No 655/2014 of the European Parliament and of the Council of 15 May 2014 establishing a European Account Preservation Order procedure to facilitate cross-border debt recovery in civil and commercial matter. Regulation 655/2014 introduces a possibility for obtaining a freezing order before the proceedings on the substance of the matter. A request for obtaining the Order must contain a certain form, have a certain content and all the necessary instruments specified in the Regulation 655/2014. The account remains frozen until the Order is revoked or until the enforcement of the Order is terminated. Each party to the proceeding has a right to appeal which has to be lodged in accordance with the time-limit specified in the Regulation 655/2014. If a debtor holds more accounts from which a creditor has to be recovered, the schedule of recovery will be determined. The thesis elaborates in detail the situations in which the Order can be obtained, its functions, consequences and the subjects to whom it may be applied.
