Abstract
Pravo na javno okupljanje i mirne prosvjede jedno je od temeljnih ljudskih prava. Navedeno pravo je temelj demokracije i vladavine prava. Ovo pravo pruža pojedincima oblikovanje društva u kojima žive i utjecaj na odluke državne ili lokalne vlasti. Iako pravo na javno okupljanje i mirne prosvjede nije apsolutno i postoje ograničenja, neosiguravanje tog prava od strane državne vlasti znak je represije i zahtjeva svaku osudu. Ostvarivanje prava na mirne prosvjede koje se nadopunjuje i presijeca s ostalim građanskim i političkim ljudskim pravima nikada nije bilo toliko upitno kao unazad dvije godine tijekom epidemije Covid-19. Epidemija je donijela izazov kako i na koji način omogućiti javna okupljanja, a ne ugrožavati zdravlje ljudi i držati se mjera koje su donosile vlade i stožeri civilne zaštite ili njima slična tijela svih država. Iako u većini zemalja zabranjeni, prosvjedi su se ipak održavali i to u nekim novim inovativnim oblicima početkom epidemije da bi nakon nekog vremena građani ponovno izašli na ulice i prosvjedovali baš protiv mjera koja su im ugrožavala osnovna ljudska prava. Ovaj rad stavlja naglasak na pravo na javno okupljanje i mirne prosvjede i ostvarivanjem tog prava u vrijeme epidemije Covida 19.
Abstract (english)
The right to public assembly and peaceful protests is one of the fundamental human rights. This right is the foundation of democracy and the rule of law. This right gives individuals the ability to shape the society in which they live and to influence the decisions of the state government. Although the right to public assembly and peaceful protests is not absolute and there are restrictions, the failure of the state authorities to ensure this right is a sign of repression and requires all condemnation. The exercise of the right to peaceful protest, which complements and intersects with other civil and political human rights, has never been so questionable as it was two years ago during the Covid-19 epidemics. The epidemic brought a challenge on how and in what way to enable public gatherings, and not endanger people's health, and adhere to the measures adopted by the governments and Civil Protection Headquarters of all countries. Although banned in most countries, protests took place in some new innovative forms at the beginning of the epidemic, and after a while citizens took to the streets again to protest against measures that threatened the basic human rights. This paper deals with the right to public assembly and peaceful protests and the exercise of that right during the Covid-19 epidemic.
