Abstract
Prestanak bračne zajednice razvodom za mnoge partnere je dugotrajan proces kojim nastoje prekinuti sve veze, no u većini slučajeva je to nemoguće posebice ako bračni partneri imaju zajedničko dijete. Istraživanja su pokazala da svaki peti brak u RH završi razvodom, a stopa razvoda braka povećala u posljednjih šezdeset godina na međunarodnoj razini pa se brojni stručnjaci počinju intenzivnije baviti pitanjima razvoda braka. Ostati u braku zbog dobrobiti djeteta ili se razvesti zbog dobrobiti djeteta – osobna su mišljenja, no posebno je važan onaj dio razvoda braka koji se odnosi na dobrobit djeteta. Nakon UN-ove Konvencije o pravima djeteta, na dijete se počinje gledati kao na osobu koja ima prava i čija se prava trebaju zaštititi, u čiju su svrhu doneseni brojni međunarodni dokumenti na regionalnoj razini. Na razini Republike Hrvatske najvažniju ulogu igra Obiteljski zakon (NN 103/15, 98/19) kojim se uređuju odnosi između roditelja i djece, ostvarivanje osobnih odnosa i uzdržavanje nakon razvoda, ali i određena procesna prava u postupku razvoda kao i postupanje nadležnih tijela. S obzirom da se razvod braka pozicionirao na drugo mjesto najstresnijih događaja u životu čovjeka, u smanjenju psihosocijalnih posljedica razvoda braka na djecu će važnu ulogu odigrati socijalni radnik koji je jedan od ključnih dionika u zaštiti dječjih prava.
Abstract (english)
Termination of marriage through divorce is a long-term process for many partners in which they try to end all relationships, but in most cases this is impossible, especially if the partners have a child together. Research has shown that every fifth marriage in the Republic of Croatia ends in divorce, and the divorce rate has increased in the last 60 years at the international level, so many experts are starting to deal with divorce issues. Staying married for the sake of the child or getting divorced for the sake of the child - these are individual opinions, but the part that relates to the well-being of the child is important. After the UN Convention on the Rights of the Child, the child began to be seen as a person who has rights and whose rights should be protected, for the purpose of which numerous laws were passed at the regional level. At the level of the Republic of Croatia, the most important is the Family Law (NN 98/19), which regulates relations between parents and children in divorce, as well as other stakeholders in divorce proceedings. Given that divorce is positioned as the second most stressful event in life, a social worker who is one of the stakeholders in protecting children's rights will play an important role in reducing the psychosocial consequences of divorce on children.
