Abstract
Rad se bavi analizom postojećeg pravnog okvira glede statusa kajaka na moru u Republici Hrvatskoj; točnije pravnom definicijom te položajem kajaka kao plovila u domaćem sustavu sigurnosti plovidbe. Nerazdvojna komponenta razmatranju relevantnih činjenica jesu i sami subjekti – kajakaši, koji će se u radu dijeliti na sportaše, profesionalne vodiče, instruktore te jednostavno veslače/upravljače plovilom. Razlikovat će se i vrste kajaka obzirom na namjenu i kontrukciju te problematizirati jednoznačnost pojma u domaćem zakonodavstvu, o čemu će biti učinjena usporedba s francuskim modelom individualizacije ovih plovila obzirom na spomenute značajke. Pravni okvir će se kao predmet rada analizirati počevši od međunarodnih pravila (COLREG, SOLAS) i domaćih pravila sigurnosti plovidbe sve do autonomnih izvora na koje upućuju određena zakonska pravila, ali i ispitivati kroz odgovore relevantnih ispitanika o praktičnim učincima ove specifične vrste plovidbe te zaključno promatrati kroz realizaciju praktične sinteze svega navedenog u vidu pojedinačnih pravnih akata donesenih od ovlaštenih tijela sustava sigurnosti plovidbe.
Abstract (english)
The paper analyses existing legal framework regarding the status of sea kayaks in the Republic of Croatia; its legal definition and the position of kayaks as vessels in the domestic safety of navigation in particular. An inseparable component of the consideration of relevant facts are the subjects themselves - kayakers, who will be divided into athletes, professional guides, instructors and simply rowers / boat operators. The types of kayaks will also differ in terms of purpose and construction, and the ambiguity of the concept in domestic legislation will be problematized, which will be compared with the French model of individualization of these vessels with regard to the mentioned features. The legal framework will be analyzed; starting with international rules (COLREGs, SOLAS) and domestic rules of safety of navigation, encompassing autonomous sources referred to by certain legal rules, but also examined through the answers provided by relevant respondents on the practical effects of this specific type of navigation, and will consequently be observed through the realization of a practical synthesis of all the above in the form of individual legal acts adopted by the authorized bodies of the navigation safety system.
